- General provisions
1.1. In accordance with Article 11 of the Law of Ukraine “On Electronic Commerce” and Articles 633 and 634 of the Civil Code of Ukraine, this agreement is the Seller’s public proposal to conclude a contract of sale of the Goods presented in the Online shop. The offer establishes the rules and procedure for selling Goods through the Online shop and governs the relationship between the Seller and the Buyer arising from the purchase of Goods through the Online shop.
1.2. By concluding the Agreement, the Buyer accepts in full the terms and procedure for placing an Order, paying for the Goods, delivering the Goods, returning the Goods and all other terms of the Agreement. The Agreement is binding on the parties.
1.3. If the Buyer does not agree with the rules and terms of the Agreement, the Buyer must stop using the Website.
1.4. The information about the Goods displayed on the Website is dynamic: it may be updated, changed and supplemented by the Seller at any time without prior notice to the Buyer. Up-to-date information about the Goods, the terms of promotions and the prices of the Goods are displayed on the Website.
1.5. The description of the Goods on the Website may differ from other internet resources and specialist websites, as it may contain elements of the subjective artistic vision of the Seller’s staff or of other users (Buyers) of the Website expressing their own opinion in a description (review). The Seller is not responsible for such information.
1.6. The Buyer may leave a review, which will be published on the Website, provided that: (a) the Buyer has purchased from the Seller the Goods being reviewed; (b) the review contains no obscene language, insults, defamation or other elements contrary to moral standards. The Seller reserves the right to the final moderation of reviews at its own discretion.
1.7. The Seller may unilaterally change the terms of the Agreement at any time. Changes take effect from the moment the new version of the Agreement is posted on the Website. Orders are governed by the version of the Agreement in force at the time the Order is placed.
1.8. In order to document the content of agreements, monitor the quality of service and protect its legitimate interests, the Seller may record telephone conversations with the Buyer. By making or receiving a telephone call, the Buyer confirms consent to such recording.
1.9. The Seller acts as a distributor of perfume and cosmetic products of the relevant manufacturers (brands). Information about the purpose of the Goods, their main characteristics, nominal contents, shelf life and precautions for use is given on the product page on the Website and/or on the labelling (label, leaflet) of the Goods, and is also provided to the Buyer on request before the order is placed. The list of ingredients (INCI) corresponds to the data of the manufacturer of the relevant product and is provided at the Buyer’s request.
1.10. The Goods are sold in compliance with the requirements of the legislation of Ukraine on making cosmetic products available on the market, including the transitional provisions of Resolution of the Cabinet of Ministers of Ukraine No. 65 of 20.01.2021 (as amended by Resolution of the Cabinet of Ministers of Ukraine No. 737 of 04.06.2026), under which cosmetic products placed on the Ukrainian market before 03.08.2026 may be made available on the market until the end of their shelf life. The date on which the Goods were placed on the market is recorded in the Seller’s accounting system.
- Acceptance of the offer
2.1. The Agreement is deemed concluded (accepted) from the moment the Buyer fills in the relevant details in the registration form on the Website or places an Order through the Website operator, provided that the Buyer receives an electronic confirmation of the Order from the Seller and the Buyer’s funds are received in the Seller’s account.
- Procedure for placing an order
3.1. The Buyer places an Order independently on the Website using the “Basket” form or by the telephone number given in the “Contacts” section of the Website.
3.2. When placing an Order, the Buyer undertakes to provide: surname, first name and patronymic; email; delivery address; contact telephone number.
3.3. Having placed an Order, the Buyer independently checks that the choice of Goods and the information about themselves are correct.
3.4. By clicking “Place order”, the Buyer confirms that, in a convenient and accessible way in accordance with Part 2 of Article 13 of the Law of Ukraine “On Consumer Rights Protection”, they have received from the Seller information about: the Seller’s name, location and procedure for accepting claims; the main characteristics of the products; the price, including the delivery charge, and the payment terms; warranty obligations and other related services; the period for accepting offers; the procedure for terminating the agreement; other terms of delivery or performance of the agreement.
3.5. After placing an Order, the Buyer receives a notification that the Order has been accepted by email or by telephone.
3.6. The name, quantity and price of the Goods selected by the Buyer are shown in the Buyer’s basket on the Website.
3.7. The Buyer agrees that Goods placed in the “Basket”, their quantity, assortment and price are valid only at the moment the “Basket” is formed and may change if the Buyer does not place the Order straight away.
3.8. The Buyer may name a third party as the recipient of the Ordered Goods by entering in the Order form the details needed to identify the recipient and make the delivery.
3.9. If either party needs additional information, it may request it from the other party. If the Buyer fails to provide the necessary information, the Seller is not responsible for the consequences related to fulfilling such an Order.
3.10. The Seller may refuse to accept an Order from the Buyer if the details provided by the Buyer are incomplete or raise doubts as to their accuracy.
3.11. If the Goods are not in stock, the Seller informs the Buyer and may offer similar Goods. If the Buyer declines, the Seller may cancel the Order and refund the amount paid.
3.12. After the Order is placed, the Buyer’s details are entered into the Seller’s database.
3.13. The Buyer confirms that the Goods they have Ordered are purchased exclusively for personal (consumer) use and are not intended for resale or other business activity.
3.14. The Seller may impose restrictions on placing an Order if the quantity of Goods placed in the “Basket” exceeds 3 (three) identical units of any selected Goods.
3.15. The Seller may refuse to accept an Order and ship the Goods if, in the Seller’s opinion, the Buyer intends to use the Goods for questionable or unlawful activity.
- Price of the goods
4.1. The prices of the Goods are set by the Seller independently and are shown on the Website in hryvnias. The Seller is not a value added tax payer; VAT is not included in the price and is not charged additionally.
4.2. Goods marked “to order” have an approximate price; the final price is communicated to the Buyer by email or by telephone.
4.3. Prices may be changed by the Seller unilaterally. The price of Goods fully paid for by the Buyer cannot be changed, except for “to order” items; in the event of a significant price difference for such items, the Seller may refund the amount paid and cancel the Order or part of the Order.
4.4. The Seller may grant discounts and run promotions; their terms are stated on the Website and may be changed by the Seller unilaterally.
4.5. If the price of Goods is stated incorrectly, the Seller informs the Buyer so that the Order can be confirmed at the corrected price or cancelled. If the Buyer cannot be contacted, the Order is deemed cancelled and the amount paid is refunded.
4.6. The price of the Goods does not include the cost of delivery, commissions or additional charges of banks or payment systems; these are paid by the Buyer.
4.7. The Seller may automatically cancel an Order if, within two calendar days of the Order being placed, the Buyer does not answer calls and/or messages needed to confirm or clarify the details of the Order.
4.8. If an Order is cancelled automatically, the Buyer receives no advantages when placing it again and orders at the prices in force at the time of the new Order.
- Payment for the goods
5.1. The Buyer may pay for the Goods online through a payment service offered by the Seller, by bank transfer to the current account using the payment details, or on receipt of the Order (cash on delivery). The payment method is chosen when the Order is placed.
5.2. The Buyer’s payment obligations are deemed fulfilled from the moment the funds are received in the Seller’s account.
5.3. Payments are made in compliance with the legislation on the use of payment transaction recorders (cash registers); the Buyer is given a settlement document (fiscal receipt) in the cases provided for by law.
- Delivery of the goods
6.1. Delivery is made by the Nova Poshta service: to a branch, to a parcel locker or by courier to an address. The cost of delivery is according to the carrier’s current rates.
6.2. The Seller states the minimum delivery cost when an Order is placed on the Website.
6.3. The Seller may give an approximate delivery cost; the Seller is not responsible if the actual delivery cost differs from the approximate one.
6.4. The Goods are handed over to the Buyer or to the third party (recipient) named in the Order.
6.5. Before collecting the Order, the Buyer/recipient must check that the transport packaging and the Goods are intact. In the event of damage, they must inform the Nova Poshta staff and draw up a report/claim; in that case the Buyer may refuse the Order.
6.6. For Orders of UAH 4,000 or more, delivery within Ukraine is free; in other cases delivery is paid by the Buyer at the carrier’s rates. The terms of free delivery may change, which is announced on the Website.
6.7. The Seller may, at its own discretion, waive the delivery charge during promotions or as part of a loyalty programme.
- Features of the Goods. Warranties and returns
7.1. Perfume products in original bottles are supplied in the manufacturer’s factory packaging with the original labelling.
7.2. Each Decant (sample) is labelled by the Seller with at least: the name of the fragrance and the brand, the nominal volume, the bottling date and/or batch number, the shelf life, and the details of the Seller as the person who carried out the packing. Information on the composition (INCI) and precautions for use is provided on the product page and/or on the leaflet accompanying the Decant.
7.3. The Buyer understands that a Decant by its nature involves opening the manufacturer’s original bottle. The appearance of the Decant container (atomiser) does not reproduce the manufacturer’s original packaging; the contents correspond to the product of the relevant brand from the donor bottle stated in the batch labelling.
7.4. The colour, longevity and sound of a fragrance may differ slightly depending on the manufacturer’s batch, storage conditions and individual skin characteristics; such a difference is not a defect of the Goods.
7.5. The Buyer may refuse Goods of proper quality and terminate the Agreement within 14 calendar days, not counting the day of purchase, if the Goods do not suit them in shape, dimensions, style, colour or size, or for other reasons cannot be used for their intended purpose, subject to clause 7.7 of the Agreement.
7.6. Goods of proper quality are exchanged or returned if the Goods have not been used and their presentation, consumer properties, seals, labels and packaging have been preserved.
7.7. In accordance with Article 9 of the Law of Ukraine “On Consumer Rights Protection” and Resolution of the Cabinet of Ministers of Ukraine No. 172 of 19.03.1994 (Annex 3), perfume and cosmetic products of proper quality cannot be exchanged or returned. This applies in particular to perfume products in original bottles, Decants and Aroma boxes.
7.8. If at the time of exchange equivalent Goods are not on sale, the Buyer may purchase other Goods from the available range with the price recalculated, receive money in the amount of the value of the returned Goods, or make the exchange as soon as the relevant Goods are back on sale.
7.9. If the Buyer has received Goods of improper quality, they may apply to the Seller for a refund or a replacement of the Goods. Goods of improper quality are goods with significant defects or not matching the stated characteristics. The Seller is not responsible for defects that arose after the Goods were handed over to the Buyer as a result of a breach of the rules of use or storage, actions of third parties or force majeure.
7.10. The Seller exchanges or refunds the Goods if they differ fundamentally from what was ordered. Differences in design or presentation elements from the description on the Website are not a sign of improper quality.
7.11. To return an Order, the Buyer gives Nova Poshta the following details: recipient — sole proprietor (FOP) Maiatskyi Andrii Vasyl'ovych; telephone +380 50 822 44 22; address: Bucha, Kyiv region, Nova Poshta parcel locker No. 34849.
7.12. Goods of proper quality are returned at the Buyer’s expense.
7.13. Money is refunded to the Buyer within 5 (five) days. The refund method is determined by the payment method.
7.14. Recommended storage conditions for perfume products: at a temperature of +5 to +25 °C, away from direct sunlight. The shelf life of a Decant does not exceed the shelf life of the original product stated by the manufacturer.
- Gift card terms
8.1. A gift card (hereinafter the Gift Card) is an electronic document with a unique code certifying the right of its bearer to a discount on Goods on the Website equal to the amount stated on the Gift Card (its value). The Gift Card is not a means of payment. The Seller sells Gift Cards on the Website and may also provide them free of charge as part of promotions.
8.2. The Gift Card is sold on the Website as goods; a fiscal receipt for its sale is issued when payment is received. The Gift Card becomes valid once payment is received; the Seller sends it to the email address of the Gift Card buyer or, at the buyer’s choice, of the recipient on the day chosen by the buyer. Promo codes and bonuses do not apply to the purchase of a Gift Card, and no bonuses are awarded for buying one.
8.3. A Gift Card is valid for 6 (six) months from the day following its purchase; a Gift Card provided free of charge is valid until the date stated on it. A Gift Card not used within this period is cancelled.
8.4. A Gift Card can be used once: when placing an Order, its code is entered in the promo code field, and the Gift Card is redeemed in full regardless of the Order value. The Gift Card gives a discount on the Goods in the Order equal to its value, but no more than 99 (ninety-nine) percent of the value of the Goods in the Order after other discounts; the Buyer pays at least 1 (one) hryvnia in money — by card, by bank transfer or on delivery — and the Seller issues a fiscal receipt reflecting the discount. Several Gift Cards may be used in one Order (the limit in this clause applies to their total discount); they can be combined with promo codes and referral codes. The Buyer pays the rest of the Order value by any available method; part of it may be covered with bonuses (Section 9). The Gift Card is reserved for the Order when the Buyer confirms it and is redeemed once the Order is accepted for processing (after payment or confirmation of an Order with payment on delivery); if the Order is cancelled before then, the reservation is released. An Order with a reserved Gift Card that is not paid within 3 (three) days is cancelled automatically.
8.5. If the Gift Card value exceeds the discount given for it, the difference is not refunded, exchanged for cash or carried over to another Order. However, under the bonus programme (Section 9) the Seller credits a registered Buyer who used the Gift Card with bonuses equal to this difference. This credit is a loyalty measure of the Seller and is not a refund or transfer of the money paid for the Gift Card. These bonuses are available immediately, remain valid until the Gift Card expiry date and are used under the terms of Section 9 (in particular clause 9.6); clause 9.10 does not apply to them. A Buyer placing an Order without registration does not receive bonuses and is offered to register at checkout.
8.6. A Gift Card cannot be returned or exchanged for cash.
8.7. An Order that received a Gift Card discount cannot be cancelled by the Buyer. If the Seller cannot fulfil such an Order (in particular because the Goods are unavailable), the Seller issues the Buyer a new Gift Card for the amount of the Gift Card discount, valid for the term of the original Gift Card but no less than 30 (thirty) days; money paid by the Buyer is refunded in accordance with Section 7. If the Order is returned to the Seller uncollected, the Seller resends it at the Buyer’s request; the Buyer pays for the repeated delivery.
8.8. Goods that received a Gift Card discount are returned in accordance with Section 7 of the Agreement (perfume and cosmetic products of proper quality are not subject to return — clause 7.7). The Gift Card discount attributable to returned Goods is compensated with a new Gift Card valid for the term of the original one, but no less than 30 (thirty) days; money paid for these Goods is refunded in accordance with Section 7.
8.9. A Gift Card is a bearer instrument: anyone who knows its code can use it. The Seller is not liable for the use of a Gift Card by a person who learned the code through no fault of the Seller.
8.10. If two or more Gift Cards are used within one calendar day, the Seller may, to prevent fraud, request a document confirming the purchase of the Gift Card; if this is refused, the Seller may decline to give the Gift Card discount.
- Bonus programme and referral codes
9.1. The Seller runs a bonus programme (the “Programme”) for Buyers registered on the Website. A Bonus account is opened automatically upon registration and is shown in the personal account under “Bonus account”. Buyers without registration do not take part in the Programme.
9.2. Bonuses are the Seller’s conditional loyalty units: 1 (one) bonus equals a discount of 1 (one) hryvnia. Bonuses are not money, electronic money or a means of payment; they cannot be exchanged for money, transferred to other persons or inherited.
9.3. When applying a promo code with a discount of up to and including 11%, a registered Buyer may choose: (a) to receive the discount on the current Order; or (b) not to receive the discount on the current Order and instead receive bonuses to the Bonus account in twice the amount of that discount. The Seller determines the list of promo codes to which this choice applies and the discount amount for each of them.
9.4. Under the choice provided for in subparagraph (b) of clause 9.3, half of the accrued bonuses becomes available for use after the Buyer receives the Order at a Nova Poshta branch, parcel locker or from a Nova Poshta courier, and for other delivery methods — after the Order is moved to the “Completed” status. The second half becomes available 30 (thirty) calendar days thereafter. Until then, the bonuses are shown under “Bonus account” as pending.
9.5. Bonuses are valid for 12 (twelve) months from the day they became available for use. Unused bonuses are cancelled after this period. Bonuses are used in order: those expiring earliest are deducted first. The Seller may remind the Buyer by email about bonuses that are about to expire.
9.6. When placing an Order, a registered Buyer may pay with bonuses for part of the cost of the Goods, but not more than 50% (fifty percent) of the cost of the Goods in the Order. Delivery cannot be paid with bonuses. The use of bonuses constitutes a discount granted to the Buyer in the corresponding amount, which is reflected in the settlement document.
9.7. Each registered Buyer receives a personal referral code and link in the personal account (the “Code Owner”). A Buyer who has not previously placed Orders with the Seller (the “New Buyer”) may apply another person’s referral code once, when placing their first Order, and receive a 10% discount on the Goods in that Order. The Code Owner receives bonuses of 5% of the cost of the Goods in the New Buyer’s Order (after the discount), which become available 30 calendar days after the New Buyer receives the Order. The number of New Buyers a Code Owner may refer is not limited. A New Buyer is identified by phone number and email address. The Code Owner may not apply their own referral code.
9.8. The Seller may issue referral codes with other terms to individual persons (in particular bloggers): the amount of the discount and bonuses, the number of uses, use not only by New Buyers; such terms are communicated when the code is applied.
9.9. A referral code cannot be combined with other promo codes in one Order, but may be applied to Goods sold at promotional prices. The choice provided for in clause 9.3 does not apply to the discount under a referral code.
9.10. If an Order is cancelled or Goods are returned (in full or in part), the bonuses accrued for that Order (including those of the Code Owner) are cancelled in proportion to the value of the cancelled or returned Goods. If such bonuses have already been used at the time of the return, their value is withheld from the amount refunded to the Buyer. Bonuses with which the Buyer paid for the returned Goods are returned to the Buyer’s Bonus account with their original validity period.
9.11. The Seller may refuse to accrue bonuses or cancel them if abuse is detected, in particular registration of several accounts by one person, use of a referral code by the Code Owner through another account, or mass placement of Orders for the purpose of obtaining bonuses.
9.12. If the Buyer’s account is deleted, the bonuses on their Bonus account are cancelled.
9.13. The Seller may change the terms of the Programme or terminate it by publishing the changes on the Website. Bonuses accrued before the changes take effect remain valid until the end of their term on the terms in force at the time of accrual.
- Liability of the parties
10.1. The parties are liable for non-performance or improper performance of the terms of the Agreement in the manner provided for by the Agreement and the current legislation of Ukraine.
10.2. The Seller is not responsible for changes made by the manufacturer to the appearance and contents of the Goods.
10.3. In the event of force majeure, the parties are released from liability for failure to perform the terms of the Agreement.
10.4. If the terms of an Order change, the Seller’s liability is limited to the Buyer’s right to refuse the Order and demand a refund of the amount paid.
10.5. The Buyer is responsible for the accuracy of the details given in the Order; losses and expenses of the Seller caused by incorrect details are borne by the Buyer.
10.6. The Seller keeps documents on the origin of the Goods and the supply chain and provides the information required by law to the state market surveillance authorities in the manner and to the extent determined by the legislation of Ukraine.
- Confidentiality and personal data protection
11.1. The Seller collects and processes the personal data that the Buyer provides independently when placing an Order, in accordance with Law of Ukraine No. 2297-VI of 01.06.2010 “On Personal Data Protection” and the Agreement.
11.2. Personal data are processed for the purpose of processing Orders, arranging delivery and ensuring consumer guarantees; in certain cases, for sending personalised offers and notifications about promotions, provided the Buyer does not object.
11.3. By providing personal data, the Buyer gives the Seller voluntary consent to their processing and use (including transfer) in accordance with the law.
11.4. The Seller undertakes not to disclose information received from the Buyer, except for transfer to counterparties and third parties to ensure performance of the Agreement (carriers, banks, payment services, etc.) and in cases established by law.
11.5. The Buyer is responsible for keeping their personal data up to date.
11.6. The Buyer has the rights of a personal data subject provided for by Article 8 of the Law of Ukraine “On Personal Data Protection”, in particular the right to access their data, to have them changed or destroyed, to withdraw consent, and to apply to the Ukrainian Parliament Commissioner for Human Rights or to a court.
11.7. Requests concerning the processing of personal data are considered by the Seller within 30 (thirty) calendar days.
- Cookies and information messages
12.1. The Buyer consents to the use of cookie technology. Cookies are used to improve the quality of services, quickly identify the visitor and save their settings, and cannot read information from the Buyer’s hard drive.
12.2. By registering on the Website, the Buyer consents to receiving information messages from the Seller and its partners at their email address.
12.3. The Buyer may unsubscribe from the mailing at any time using the link in the email.
- Rules for using materials posted on the website
13.1. The Website contains materials, trademarks, trade names and other objects protected by law, including texts, photographs and graphic images.
13.2. The trademarks (marks for goods and services) of perfume manufacturers mentioned on the Website belong to their right holders and are used solely to identify the Goods and inform the Buyer.
13.3. All content of the Website is protected by the legislation of Ukraine and international treaties. Use of the Website materials without the Seller’s consent is prohibited.
13.4. All rights to the Website as a whole and to the use of the domain name mayparfum.com belong to the Seller.
- Other terms
14.1. The Website may be temporarily unavailable during maintenance or other work, or for other technical reasons.
14.2. If questions or claims arise, the Buyer may contact the Seller by email at info@mayparfum.com or by the telephone numbers given on the Website. Disputes are settled by negotiation.
14.3. If agreement cannot be reached through negotiation, the dispute is referred to a court in accordance with the legislation of Ukraine.
14.4. A court’s finding that any provision of the Agreement is invalid does not render its other provisions invalid.
